Program Description
Bane Excavation, LLC (“Bane Excavation,” “we,” “us,” or “our”) provides text-message communications regarding excavation, underground utilities, sitework, estimates, customer inquiries, project scheduling, jobsite access, material deliveries, and coordination with customers, general contractors, subcontractors, and suppliers.

Eligibility and Consent
You may receive SMS messages from Bane Excavation only after providing consent appropriate to the messages being sent. Consent is not a condition of purchasing services. An inbound text authorizes responses relevant to that inquiry, but does not by itself authorize unrelated or ongoing outbound messaging.

Verbal Consent (In Person or by Telephone)
Customers and business contacts may opt in verbally during a telephone call, in-person meeting, jobsite visit, or other direct conversation. Before requesting agreement, Bane Excavation explains the purpose and types of texts, that message frequency varies and message/data rates may apply, how to reply STOP to unsubscribe or HELP for assistance, and how to access the SMS Privacy Policy and these Terms. We request an affirmative agreement and record the date, phone number, consent method, and the scope of messages authorized. Verbal agreement is used only for communications covered by that consent.

Other Consent Methods
Where available, individuals may also opt in through a written or electronic consent form containing the required SMS disclosure. If someone initiates a text conversation, we may respond to that specific request; additional or recurring communications require appropriate consent.

Types of Messages
Messages may include responses to service inquiries, scheduling or appointment confirmations, requested estimate and proposal follow-ups, project progress and coordination updates, material delivery arrangements, and other communications related to requested or ongoing construction services. We do not use this program for unsolicited mass-marketing texts.

Message frequency varies based on your request, project activity, and communication needs. Message and data rates may apply. Contact your wireless provider for information about your text-messaging plan.

Opt-Out
You may opt out at any time by replying STOP to a text message from us. After opting out, you may receive a final confirmation message. We will honor opt-out requests for this SMS program. You may continue contacting our business by telephone or email.

Privacy
We handle personal information in accordance with our Bane Excavation, LLC SMS Messaging Privacy Policy, provided with these Terms or available through our published business contact channels. Delivery and Availability
SMS delivery may be affected by wireless carrier availability, coverage, device settings, or technical interruptions. Mobile carriers are not liable for delayed or undelivered messages. SMS is not intended for emergency communications or time-critical jobsite safety instructions.
